A $1,350,000 settlement was reached in a motorcycle collision where the plaintiff was struck and killed by an oncoming vehicle that made an unexpected left turn in front of him. The 45 year old plaintiff suffered significant blunt force injuries and was pronounced dead at the local Hospital emergency department. The defendant was insured by Amica. Liability was contested and the plaintiff’s speed at the time of crash was a significant factor in the mediation. An appraisal of economic loss was prepared on the plaintiff’s behalf as was an accident reconstruction report. Total available insurance was $1,500,000. The mediation was conducted by former Judge Antonio Robaina. Submitted by Patrick J. Cooney and William J. Tracy of Furey, Donovan, Tracy & Daly, PC, Bristol.
